Common use of Notice and Variation Clause in Contracts

Notice and Variation. (a) The practitioner shall give not less than four (4) weeks notice in writing to the employer of the date the practitioner proposes to commence paid or unpaid parental leave stating the period of leave to be taken. (b) A practitioner seeking to adopt a child shall not be in breach of subclause 7(a) by failing to give the required period of notice if such failure is due to the requirement of the adoption agency to accept earlier or later placement of a child, or other compelling circumstances. (c) A practitioner proceeding on parental leave may elect to take a shorter period of parental leave and may at any time during that period elect to reduce or extend the period stated in the original application, provided four (4) weeks written notice is provided.
