Common use of Notice of Borrowing Representation Clause in Contracts

Notice of Borrowing Representation. Each Notice of Borrowing given by a Borrower in accordance with Section 10.1 hereof and the acceptance by Borrower of the proceeds of a Revolving Credit Loan and/or Equipment Line Loan shall constitute a representation and warranty by the Borrower, made as of the time of the making of such Loan, that the conditions specified in Sections 12.1 and 12.2 have been fulfilled as of such time.
