Notice of Breach of Standards of Performance. The Joint Board shall give a Breach of Standards of Performance Notice to TSP promptly after the Joint Board obtains Actual Knowledge that any Work does not comply with the TSP Standards of Performance. If the Joint Board fails to provide written notice promptly after obtaining Actual Knowledge thereof, such failure shall not constitute a waiver of the Joint Board’s rights under this Section 11, but TSP shall not be responsible for the increase in Cost, if any, resulting from the Joint Board’s failure to provide timely written notice.
