Monitoring of Performance. Vendor shall continuously monitor and record its performance to ensure that all of Vendor's responsibilities and obligations hereunder are being met and fulfilled. Citizens may conduct programmatic and other administrative contract monitoring during the term of this Agreement. The purpose of this monitoring is to ensure that all of Vendor's responsibilities and obligations are being met and fulfilled. Such monitoring may include on-site visits, report reviews, invoice reviews, compliance reviews, and a review of any other areas reasonably necessary. Vendor acknowledges and agrees that Citizens may also monitor and record Vendor Staff communications to the extent they occur within or are connected to any Citizens’ resource, such as electronic or telecommunications systems.

At any time during this contract, Citizens’ Contract Manager may request a business review meeting with the Vendor. The business review meeting will generally be held at Citizens’ facilities as needed and shall include Vendor’s performance for the previous six (6) months, based on the Contingent Worker’s satisfaction survey and metrics defined in the Reports delivered to Citizens.
Monitoring of Performance. The Council (or any other agency or the State, Commonwealth or NPS) shall have the right during the term of this contract and for the period limited by the applicable statute of limitations to insure that the services provided or to be provided by the Vendor have been provided as herein agreed. The Council shall have the right to monitor the total operations of the program, including but not limited to actual program activity and the preparation of a progress report and evaluation by the Council. The Vendor shall submit to the Council a brief written mid-term report due February 28, 2020. The Vendor hereby consents to the examination of Vendor's records and agrees to provide or permit the Council to examine or obtain copies of any documents relating to the performance of to this contract. The right of the Council hereunder shall not be dependent upon the Council bringing any action to enforce this provision. Monitoring of Performance. 12.1 The Service Provider shall be responsible for monitoring its performance of the Services and its other obligations under this Agreement and for reporting on that performance to the Network Operators in accordance with Clause 13, Schedule 4 and Schedule 6. If the Service Provider fails to provide the Services in accordance with the Service Standards or the Performance Indicators, the Service Provider shall: (a) identify the cause of any failure to provide the Services in accordance with a specific Service Standard or Performance Indicator and the extent to which, if at all, any Network Operator may have contributed to that failure; (b) inform each Network Operator of such action necessary to correct such failure and prevent it from recurring, in accordance with paragraphs 1.2(a) to (e) of Schedule 9; and (c) keep each Network Operator advised of the status of remedial efforts and any rectification being undertaken.

Monitoring of Performance. 15.1 The Developer shall provide the Grantor's Representative with accurate and complete information with respect to the Early Studies, the Early Project Construction Works, the Phase 1A Construction Works, the Phase 1B Construction Works and the O&M Works (as the case may be) and the events affecting the performance of the relevant Construction Works and the operation and maintenance of the Toll Road to the extent such information is required, in the reasonable opinion of the Grantor, to enable the Grantor to monitor the performance by the Developer of its obligations under this Agreement or to exercise the Grantor's rights thereunder. 15.2 The Developer shall immediately after it becomes apparent notify the Grantor's Representative of all incidents of whatsoever nature affecting or likely to affect materially the progress of the Construction Works or the performance of the O&M Works. 15.3 The Developer shall maintain its books and records in the manner described in the Concession Specification for a period of at least five years and shall permit the Grantor to have access to all such books and records and all other information in its possession as may be required in the reasonable opinion of the Grantor to enable the Grantor to monitor the performance by the Developer of its obligations under this Agreement, or to exercise the Grantor's rights thereunder, or to verify amounts due from one Party to the other under this Agreement, to audit the same and to take copies of all or part thereof. 15.4 In the event that a matter has been referred to an Expert for determination, the Developer shall also permit the Expert to have access to its books and records and all other information in its possession as the Expert may require in order to determine the matter in question, and to take copies of all or part thereof for such purpose, and the Developer agrees and acknowledges that the Grantor is entitled to disclose copies of the same in its possession to the Expert. 15.5 The provisions of clauses 15.2 and 15.3 are subject to the provisions of Clause 44 (Confidentiality). 15.6 During the Concession Period the Developer shall supply the Grantor's Representative with such information as is required to be provided by the Developer pursuant to the Concession Specification or as may be reasonably required by the Grantor's Representative having regard to the Grantor's statutory duties or the obligations to be performed by the Developer under this Agreement. 15.7 The Grant...
