Notice of Denial and Appeal Process. The housing provider shall: o promptly send a written and electronic notice (to the addresses provided) to each applicant denied admission with a written and/or electronic copy to the referring agency and the funding agency. The notice should: ▪ list all the reasons for the rejection, including the particular conviction or convictions that led to the decision in cases where past criminal offenses were a reason for rejection; ▪ explain how the applicant can request an in person appeal to contest the decision; ▪ state that an applicant with a disability is entitled to request a reasonable accommodation to participate in the appeal; ▪ inform the applicant that he or she is entitled to bring an advocate or attorney to the in person appeal; ▪ provide referral information for local legal services and housing rights organizations; ▪ describe the evidence that the applicant can present at the appeal; o give applicants denied admission a date within which to file the appeal, which shall be at least ten (10) business days from the date of the notice; o unless an extension is agreed to by the applicant and the housing provider, hold the appeal within ten (10) business days of the request for the appeal; o confine the subject of the appeal to the reason for denial listed in the notice; o give the applicant a chance to present documents and/or witnesses showing that he or she will be a suitable tenant; o have an impartial supervisor or manager from the housing provider, but who is not the person who made the initial decision or a subordinate of the person who made the initial decision, conduct the appeal;
