Common use of Notice of Dispute Clause in Contracts

Notice of Dispute. If a dispute or difference arises between the Contractor and the Commonwealth or between the Contractor and the Contract Administrator in respect of any fact, matter or thing arising out of or in connection with the Contractor's Activities, the Works or the Contract, or either party's conduct before the Contract, the dispute or difference must be determined in accordance with the procedure in clause 15. Where such a dispute or difference arises, either party may give a notice in writing to the Contract Administrator and the other party specifying: the dispute or difference; particulars of the party's reasons for being dissatisfied; and the position which the party believes is correct.

Notice of Dispute. If a dispute or difference arises between the Contractor Subcontractor and the Commonwealth Contractor (or between the Contractor and the Contract Administrator Contractor's Representative) in respect of any fact, matter or thing arising out of or in connection with the ContractorSubcontractor's Activities, the Subcontract Works or the ContractSubcontract, or either party's conduct before the ContractSubcontract, the dispute or difference must be determined in accordance with the procedure in this clause 15. Where such a dispute or difference arises, either party may give a notice in writing to the Contract Administrator and the other party specifying: the dispute or difference; particulars of the party's reasons for being dissatisfied; and the position which the party believes is correct.

Notice of Dispute. If a dispute or difference arises between the Contractor Consultant and the Commonwealth Contractor or between the Contractor Consultant and the Contract Administrator Contractor's Representative in respect of any fact, matter or thing arising out of or in connection with the Contractor's ActivitiesServices, the MCC Works or the ContractSubcontract, or either party's conduct before the ContractSubcontract, the dispute or difference must be determined in accordance with the procedure in clause 1513. Where such a dispute or difference arises, either party may give a notice in writing to the Contract Administrator Contractor's Representative and the other party specifying: the dispute or difference; particulars of the party's reasons for being dissatisfied; and the position which the party believes is correct.

If a dispute or difference arises between the Contractor Subcontractor and the Commonwealth Contractor (or between the Contractor and the Contract Administrator Contractor’s Representative) in respect of any fact, matter or thing arising out of or in connection with the Contractor's Subcontractor’s Activities, the Subcontract Works or the ContractSubcontract, or either party's ’s conduct before the ContractSubcontract, the dispute or difference must be determined in accordance with the procedure in clause 15.
