Pfenex has not received any written notice or written threat from any Third Party asserting or alleging, nor does Pfenex have any knowledge of any basis for any assertion or allegation, that any use or creation of Pfenex IP by Pfenex prior to the Effective Date misappropriated the intellectual property rights of such Third Party.
