Common use of Notice of Variation Clause in Contracts

Notice of Variation. If a direction by the Contractor's Representative, other than a Variation Order under clause 10.2, constitutes or involves a Variation, the Consultant must, if it wishes to make a Claim against the Contractor arising out of or in connection with the direction: within 7 days of receiving the direction and before commencing any services relating to the subject matter of the direction, give notice to the Contractor's Representative that it considers the direction constitutes or involves a Variation; within 21 days after giving the notice under paragraph (a), submit a written claim to the Contractor's Representative which includes the details required by clause 14.3(b); and continue to carry out the Services in accordance with the Subcontract and all directions of the Contractor's Representative, including any direction in respect of which notice has been given under clause 14.1.
