Notice to Mezzanine Lender. Subject to the Condominium Documents and provided that no Event of Default has occurred and is continuing, Lender shall attempt in good faith to notify Xxxxxxxxx Administrative Agent of a proposed settlement of Proceeds over which Xxxxxx has either a consent or approval right in this Agreement (without granting or agreeing to any Mezzanine Administrative Agent consent or approval right).
