Common use of Notification of delayed delivery Clause in Contracts

Notification of delayed delivery. If the Contractor finds that the agreed time of delivery cannot be met or appears unlikely to be met, they shall, without delay, notify the Purchaser of this in writing. Such notification shall include reason(s) for the delay and the expected date(s) by which delivery can be made. If delay in delivery is caused by the Purchaser, circumstances within the Purchasers control or circumstances specified in ALOS 05 E, article 25, Grounds for Relief (Force Majeure), and notification has been given as specified above, the time of delivery shall be extended to a time justified by the circumstances.
