Common use of Notification of Environmental Claims Clause in Contracts

Notification of Environmental Claims. The Borrower shall inform the Agent in writing as soon as reasonably practicable upon becoming aware of the same: a) if any Environmental Claim has been commenced or (to the best of the Borrower’s knowledge and belief) is threatened against any of the Obligors, the Charterers, the Managers or any of the Vessels; and b) of any fact and circumstances which will or are reasonably likely to result in any Environmental Claim being commenced or threatened against any of the Obligors, the Charterers, the Managers or any of the Vessels, where the claim would be reasonably likely, if determined against the Obligors or any of the Vessels, to have a Material Adverse Effect.
