Common use of Notification of Exemptions Clause in Contracts

Notification of Exemptions. 2.1 DBS Private Bank has been granted an exemption (the “Exemption”) for specialised units serving High Net Worth Individuals under Section 100(2) of the Financial Advisers Act and is therefore exempted from compliance with the following: (a) Sections 25, 27, 28 and 36 of the Financial Advisers Act; (b) MAS Notice on Recommendation of Investment Products; (c) MAS Notice on Appointment and Use of Introducers by Financial Advisers; (d) MAS Notice on Information to Clients and Product Information Disclosure; and (e) MAS Notice on Minimum Entry and Examination Requirements for Representatives of Licensed Financial Advisers and Exempt Financial Advisers. 2.2 With the Exemption, DBS Private Bank is not required to comply with the statutory provisions and notices set out in this Clause 2 (which include, among other things, the requirement to have a reasonable basis for making a recommendation with respect to any investment product and the obligation to disclose product information to customers) when providing financial advisory services to High Net Worth Individuals. 2.3 You hereby represent and warrant that you are a High Net Worth Individual for the purposes of the Exemption and acknowledge that the Exemption shall apply to you and your dealings with DBS Private Bank.
