Common use of Notification of Hazardous Substances Clause in Contracts

Notification of Hazardous Substances. NYSEG shall notify National Grid during the construction of any of the ATP facilities of any known Hazardous Substances, or unsafe, dangerous, or potentially dangerous, conditions or structures, whether above-ground or underground, that are present on, under, over, or in NYSEG’s owned, occupied, used, managed or operated facilities or property (including, without limitation, easements, rights-of-way, or other third-party property) to be used or accessed in connection with the Work or otherwise under or relating to this Agreement.
