Notification of Non-Compliance. In addition to the other reports required by this Order on Consent, if Respondents fail to comply with any requirement of this Order on Consent, Respondents shall notify the Department of such failure and the likely duration of the period of noncompliance in writing within ten (10) working days of the day Respondents first becomes aware of the noncompliance, with an explanation of the violation’s likely cause and of the remedial steps taken, and/or to be taken, to prevent or minimize it. If the cause of the noncompliance cannot be fully explained at the time the report is due, Respondents shall include a statement to that effect in the report. Respondents shall immediately investigate to determine the cause of the noncompliance and then shall submit an amendment to the report, including a full explanation of the cause of the noncompliance, within thirty (30) days of the day Respondents becomes aware of the cause of the noncompliance.
