Common use of NSF CHECKS Clause in Contracts

NSF CHECKS. ( , Initial) In the event the Tenant’s payment check is returned by Landlord/Agent’s Bank for insufficient funds (NSF), the Tenant agrees to pay $50.00 for each occurrence. This is in addition to any late charges that shall also be due. One NSF payment will require all future rent and other payments be paid with guaranteed funds. Funds received shall be applied first to NSF charges, late or other fees, then rent. Rent is not considered paid or received until Tenant’s check clears the bank; therefore, late fees will apply in addition to the NSF fee.
