Common use of Obligation to Complete the Construction of the Apartment Complex Clause in Contracts

Obligation to Complete the Construction of the Apartment Complex. (a) The Developer, in its capacity as the Developer and not as a General Partner, shall be obligated to complete the construction of the Apartment Complex and achieve Permanent Mortgage Commencement in the manner set forth in this Agreement and the Development Agreement. (b) The completion of the Apartment Complex shall be secured by the Guaranty.

Obligation to Complete the Construction of the Apartment Complex. (a) The Developer, in its capacity as the Developer and not as a General Partner, and the General Partner shall be obligated to complete the construction of the Apartment Complex and pay all costs necessary to achieve Permanent Mortgage Commencement Rental Achievement in the manner set forth in this Agreement and the Development Agreement. (b) The completion of the Apartment Complex shall be secured by a completion bond in an amount at least equal to the full amount of the Construction Contract for the Apartment Complex and by the Guaranty.
