Common use of Obligation to Notify Clause in Contracts

Obligation to Notify. In connection with discovery requests or orders pertaining confidential information in connection with this Agreement as referenced in Section 13.1(a) (“Disclosure Order”) each Party shall, to the extent practicable, use reasonable efforts to: (a) Notify the other Party before disclosing the Confidential Information; and (b) Prevent or limit such disclosure. After using such reasonable efforts, the Disclosing Party will not be: (c) Prohibited from complying with a Disclosure Order; or (d) Liable to the other Party for monetary or other damages incurred in connection with the disclosure of the Confidential Information.
