Common use of Obligation to Repair or Rebuild Clause in Contracts

Obligation to Repair or Rebuild. If the Premises or Building shall be damaged or destroyed by fire or other casualty, Tenant shall promptly notify Landlord of any damage or destruction to the Premises, and Landlord, subject to the mortgagee's consent and to the conditions set forth in this Paragraph 10, shall repair, rebuild or replace such damage and restore the Premises and/or the Building, subject to subparagraph (f) below, to substantially the same condition in which they were immediately prior to such damage or destruction; provided, however, that Landlord shall only be obligated to restore such damage which is covered by the fire and other extended coverage insurance policies.

If the Premises or the Building shall be damaged or destroyed by fire or other casualty, Tenant shall promptly notify Landlord of any damage or destruction to the PremisesPremises which Tenant has knowledge or is aware of, and Landlord, subject to the its mortgagee's ’s consent and to the conditions set forth in this Paragraph 10Section 13, shall repair, rebuild or replace such damage and restore the Premises and/or the Building, subject to subparagraph (f) Section 13.f below, to substantially the same condition in which they were immediately prior to such damage or destruction; provided, however, that Landlord shall only be obligated to restore such damage which is covered by the its fire and other extended coverage all risk insurance policies.

If the Premises or Building shall be damaged or destroyed by fire or other casualty, Tenant shall promptly notify Landlord of any damage or destruction to the Premisesof which Tenant is aware, and Landlord, subject to the mortgagee's consent and to the conditions set forth in this Paragraph 10Article XIV, shall repair, rebuild or replace such damage and restore the Premises and/or the Building, subject to subparagraph (f) below, to substantially the same condition in which they were immediately prior to such damage or destruction; provided, however, that Landlord shall only be obligated to restore such damage which is covered by the fire and other extended coverage insurance policies.
