Obligation to Turn Over HOT Lanes at End of Term. Upon the last day of the Term, whether upon expiration or earlier termination, the Concessionaire shall surrender and deliver the HOT Lanes Project to the Department as provided in Section 16.05 and in accordance with Section 16.09. Not later than 180 days preceding the end of the Term, the Concessionaire and the Department shall develop a plan to assure the orderly transition of the HOT Lanes to the Department or a Department contractor.
