Common use of Obligations of Affected Party Clause in Contracts

Obligations of Affected Party. (a) Notwithstanding the foregoing, the Affected Party shall: (i) make all reasonable efforts to prevent, minimise and thereafter mitigate any delays or costs occasioned by any Force Majeure Event, including recourse to alternative acceptable sources of services, equipment and materials; and (ii) use all reasonable efforts to ensure resumption of normal performance of this Agreement after the occurrence of any Force Majeure Event and perform its obligations hereunder to the maximum extent practicable. (b) Each Party shall bear their respective costs and neither Party shall be required to pay to the other Party any costs arising out of a Force Majeure Event.
