Common use of Operational Phase Clause in Contracts

Operational Phase. During the operational phase, DESIGN/BUILDER shall: 1. Provide assistance in connection with the start-up, testing, refining and adjusting of any equipment or system included in the Work. 2. Assist OWNER in training staff to operate and maintain the Project as provided in Exhibit G. Other than assistance normally provided in the industry after final payment, nothing in this paragraph 6.01.E. shall be interpreted or construed as obligating DESIGN/BUILDER to perform or provide such assistance to OWNER after final payment and acceptance of the Work under paragraph 13.08 below.
