Common use of Opinions of Cost Clause in Contracts

Opinions of Cost. It is recognized that neither Consultant nor Owner has control over the costs of labor, material, equipment or services furnished by others or over competitive bidding, market or negotiating conditions, or construction contractors’ methods of determining their prices. Accordingly, any opinions of probable Project costs or construction costs provided for herein are estimates only, made on the basis of Consultant’s experience and qualifications and represent Consultant’s best judgment as an experienced and qualified professional, familiar with the industry. Consultant does not guarantee that proposals, bids or actual Project costs or construction costs will not vary from opinions of probable cost prepared by Consultant.

Accordingly, any opinions estimates of probable Project costs or construction costs provided for herein are estimates only, made prepared on the basis of Consultant’s experience and qualifications and represent Consultant’s best judgment as an experienced and qualified professional, a professional generally familiar with the industry. However, since Consultant has no control over the cost of labor, materials, equipment or services furnished by others, or Contractor’s methods of determining prices, or over competitive bidding or market conditions, Consultant cannot and does not guarantee that proposals, bids bids, or actual Project costs or construction costs cost will not vary from Consultant’s opinions or estimates of probable cost prepared by Consultantconstruction cost.

Accordingly, any opinions Consultant's opinion of probable Project construction/remediation costs or construction and/or operations and maintenance costs provided for herein are estimates only, to be made on the basis of Consultant’s experience and qualifications and represent Consultant’s best judgment 's judgement as an experienced and qualified professionalprofessional engineer and/or consultant, familiar with the construction industry. But, Consultant cannot and does not guarantee that proposals, bids bids, or actual Project costs or construction total construction/remediation costs will not vary from opinions of probable cost prepared by Consultant. If prior to the bidding or negotiation phase, Company wishes greater assurance as to costs, Company shall employ an independent cost estimator.
