Common use of Option of Seller Clause in Contracts

Option of Seller. Anything in this Agreement to the contrary notwithstanding, Seller shall have the option (the "Seller Option"), exercisable at any time prior to 11:00 p.m., Eastern Standard Time, on January 7, 1998, by notice to Buyer, to elect to reduce to 4,105,043 the number of shares of Common Stock to be sold to Buyer pursuant to the Agreement. Any such notice may be given in a writing delivered to Buyer by facsimile transmission at (404) 000-0000 xx to which confirmation of receipt is obtained, or by any other method specified in Section 9.1 hereof. In the event that the Seller Option is exercised, the following provisions shall be applicable:
