Option to Effect Legal Defeasance. The Company may, at any time, with respect to the Subordinated Notes, elect to have either Section 13.01 of the Indenture or Section 3.02 of this Indenture Supplement be applied to all outstanding Subordinated Notes upon compliance with the conditions set forth in Article Thirteen of the Indenture and below in this Article Three.
Option to Effect Legal Defeasance or Covenant Defeasance The Company may, at its option, evidenced by an Officers' Certificate, at any time, with respect to the Notes, elect to have either Section 8.02 or 8.03 hereof be applied to all Notes and Subsidiary Guarantees then outstanding upon compliance with the conditions set forth in this Article 8.
