Common use of Option to Terminate Clause in Contracts

Option to Terminate. If Dell removes a material feature or materially reduces the functionality of the APEX Service, then You will have the right to terminate the Order for the APEX Service by notifying Dell within 30 days from the date of Dell’s modification notice. If You elect to terminate that Order, then termination occurs on: (a) the date Dell receives Your notice of termination; or (b) any later date You specify in Your notice (though this date must not occur more than 90 days after the date Dell receives Your termination notice).

If You elect to terminate that Order, then termination occurs on: : (a) the date Dell receives Your notice of termination; or (b) any later date You specify in Your notice (though this date must not occur more than 90 days after the date Dell receives Your termination notice).

If Dell removes a material feature or materially reduces the functionality of the APEX ServiceService Offering, then Dell will notify you through the relevant portal or by email and You will have the right to terminate the Order for the APEX Service Offering by notifying Dell within 30 days from the date of Dell’s modification notice. If You elect to terminate that Order, then termination occurs on: (a) the date Dell receives Your notice of termination; or (b) any later date You specify in Your notice (though this date must not occur more than 90 days after the date Dell receives Your termination notice).
