Common use of Orbital Storage Clause in Contracts

Orbital Storage. If Purchaser places the Satellite in Orbital Storage (other than due to the inability to operate for causes attributable to Contractor), Contractor shall earn the Orbital Performance Incentives at the same rate as Contractor would be earning such incentives if the Satellite were in service.

Orbital Storage. If Except as provided in Article 13.2.5, if Purchaser places the Satellite in Orbital Storage (other than due to the inability to operate for causes attributable to Contractor)Storage, Contractor shall earn Space Segment Orbital Incentives with respect to the Space Segment and Satellite Orbital Performance Incentives with respect to the Satellite at the same rate Satellite and/or Space Segment Daily Rate as Contractor would be earning such incentives if the Satellite were had not been put in serviceOrbital Storage.

If a Satellite is returned to service following a period of Orbital Storage, the daily Orbital Performance Incentive amount shall be earned based on the performance of the Satellite consistent with Section 13.4 hereof.
