ORDINANCES AND REGULATIONS. (a) Tenant hereby covenants and agrees to comply with all the rules and regulations of the Board of Fire Underwriters Officers or Boards of the City, County and State having jurisdiction over the leased premises, and with all ordinances and regulations of governmental authorities wherein the leased premises are located at Tenant's sole cost and expense, but only in so far as any of such rules, ordinances and regulations pertain to the manner in which the Tenant shall use the leased premises; the obligation to comply in every other case and also all cases where such rules regulations and ordinances require repairs alterations changes or additions to the building (including the leased premises, but not caused by Tenant's use thereof or building equipment, or any part of either being hereby expressly assumed by Landlord, and Landlord covenants and agrees to comply with all such rules, regulations and ordinances with which Tenant has not herein expressly agreed to comply. Tenant hereby agrees to cooperate with Landlord in all respects and to comply with the above. (b) Tenant agrees to be bound by the rules and regulations set forth on the schedule attached hereto as Exhibit ''C'' initialed by the parties and made a part thereof. Landlord shall have the right from time to time to issue additional or amended rules and regulations regarding the use of the lease premises; When so issued the same shall be considered a part of this Lease and Tenant covenants that said additional or amended rules and regulations shall likewise be faithfully observed by Tenant and the employees, agents, officers servants, patrons, licensees, visitors and invitees of Tenant provided that said additional or amended rules are made applicable to at least a majority on a square foot basis) of all tenants in the building. Any failure of Tenant to abide by the aforesaid rules and regulations shall constitute a default under this Lease.

Landlord shall not be responsible for compliance with the ADA with respect to the Premises, including the design or amended rules construction thereof. Tenants waives any right, claim, defense or set off which Tenant may have, nor or hereafter, based upon any responsibility landlord may have under the ADA with respect to the Premises, the Building, the Property or otherwise. Tenant agrees that any and regulations regarding all steps taken or to be taken by Landlord, in Landlord's judgment, now or hereafter to comply with the ADA concerning the Building or the Property are authorized and permitted under the Lease and shall constitute an admission by Landlord that the ADA breach of Tenant's rights under this Lease. Nothing herein shall constitute an admission by Landlord that the ADA governs any part of the Premises, Building or Property or any activities of Landlord with respect thereto. Tenant covenants and agrees that Tenant shall not at any time maintain on, or dispose or discharge from, the Property or the Premises any "Hazardous Materials", as defined below, except Tenant may use and store minor quantities of Hazardous Materials for cleaning purposes only or in connection with the use of the lease premises; When so issued the same shall be considered a part of this Lease and Tenant covenants that said additional or amended rules and regulations shall likewise be faithfully observed by Tenant and the employees, agents, officers servants, patrons, licensees, visitors and invitees of Tenant provided that said additional or amended rules are made applicable to at least a majority on a square foot basis) of all tenants in the building. However, Landlord shall be responsible for any modifications to the Common Areas and the Building (except the Premises) necessary to comply with ADA and Tenant shall have no responsibility or amended rules liability therefor. Tenant agrees that any and regulations regarding all steps taken or to be taken by Landlord, in Landlord's judgment, now or hereafter to comply with the ADA with respect to the Building and its Common Areas are authorized and permitted under the Lease and shall not constitute an interruption, disturbance or other breach of Tenant's rights under the Lease provided, however, that Landlord shall use reasonable efforts to avoid unreasonably disrupting Tenant's use of the lease premises; When so issued the same shall be considered a part of this Lease and Tenant covenants that said additional or amended rules and regulations shall likewise be faithfully observed by Tenant and the employees, agents, officers servants, patrons, licensees, visitors and invitees of Tenant provided that said additional or amended rules are made applicable to at least a majority on a square foot basis) of all tenants in the building. Any failure of Tenant to abide by the aforesaid rules and regulations shall constitute a default under this LeasePremises.

(b) Tenant agrees Lessee shall not do or suffer to be bound done, or keep or suffer to be kept, anything in, upon or about the premises which will contravene Lessor’s policies insuring against loss or damage by fire or other hazards, or which will prevent Lessor from procuring such policies in companies acceptable to Lessor, or which will cause an increase in the rules and regulations set forth on the schedule attached hereto as Exhibit ''C'' initialed by the parties and made a part thereof. Landlord shall have the right from time to time to issue additional or amended rules and regulations regarding the use insurance rates upon any portion of the lease premises; When so issued the same shall be considered a part of this Lease and Tenant covenants that said additional or amended rules and regulations shall likewise be faithfully observed by Tenant and the employees, agents, officers servants, patrons, licensees, visitors and invitees of Tenant provided that said additional or amended rules are made applicable to at least a majority on a square foot basis) of all tenants in the building. Any failure If Lessee violates any prohibition provided for in the first sentence of Tenant the Section, Lessor may without notice to abide by Lessee, correct the aforesaid rules and regulations same at Lessee’s expense. Lessee agrees to pay to Lessor as Additional Rent on demand the amount of any increase in premiums for insurance resulting from any violation of the first sentence of this paragraph, even if Lessor shall have consented to the doing of, or the keeping of, anything on the premises which constitute such a default under violation (but the payment of such Additional Rent shall not entitle Lessee to violate the provisions of the first sentence of this LeaseSection).
