Other Excluded Services. Maintenance and support fees do not include fees for the following services: (a) initial installation or implementation of the Tyler Software; (b) onsite maintenance and support (unless ▇▇▇▇▇ cannot remotely correct a Defect in the Tyler Software, as set forth above); (c) application design; (d) other consulting services; (e) maintenance and support of an operating system or hardware, unless you are a hosted customer; (f) support outside our normal business hours as listed in our then-current Support Call Process; or (g) installation, training services, or third party product costs related to a new release. Requested maintenance and support services such as those outlined in this section will be billed to you on a time and materials basis at our then current rates. You must request those services with at least one (1) weeks’ advance notice.

Our current Support Call Process for the Tyler Software is attached to this Exhibit C at Schedule 1. Exhibit C Schedule 1 Tyler Technologies, Inc. provides the following channels of software support:
(1) Tyler Community – an on-line resource, Tyler Community provides a venue for all Tyler clients with current maintenance agreements to collaborate with one another, share best practices and resources, and access documentation.
(2) On-line submission (portal) – for less urgent and functionality-based questions, users may create unlimited support incidents through the customer relationship management portal available at the Tyler Technologies website.
(3) Email – for less urgent situations, users may submit unlimited emails directly to the software support group.
Other Excluded Services. Maintenance and support fees do not include fees for the following services: (a) initial installation or implementation of the Contractor Software; (b) onsite maintenance and support (unless Contractor cannot remotely correct a Defect in the Contractor Software, as set forth above); (c) application design; (d) other consulting services; (e) maintenance and support of an operating system or hardware; (f) support outside our normal business hours as listed in our then-current Support Call Process; or (g) installation, training services, or third party product costs related to a new release. Requested maintenance and support services such as those outlined in this section will be billed to the City on a time and materials basis at Contractor’s then current rates. The City must request those services with at least one (1) weeks’ advance notice.
Other Excluded Services. 5.1 Our services are only for the purposes of supporting you with non-medical nutrition and wellness support, therefore, unfortunately, we cannot:
(a) identify, diagnose, predict, or treat any medical condition, genetic defect, anomaly, or pattern, medical illness, immune compromise, or response, or detect or foresee any genetic marker or DNA related matter that has or may lead to any form of illness, disability, chronic, life threatening, shortening, or ending illness or event;
(b) we cannot and do not predict or guarantee specific results. We provide the process, knowledge, and tools that we use to get and maintain inner wellness through nutrition and functional foods, but how you choose to use the information and tools is up to you;
(c) we cannot and do not measure, detect, advise, or provide information or resources in relation possible genetic variations (all or some) or individual risk factors in relation to testing, reporting, results, and how you choose to use the information, if any, that you gain;
(d) we cannot and do not predict, prevent, analyse or treat form of illness or event including but not limited to any form of skin condition, IBS/IBD or related gut issues, cancer, chronic or progressive disease or illness, stroke, heart disease, heart failure or attack, metabolic-related syndrome or illness, inflammatory response, diabetes, blood pressure condition, irregularity or control, hormone-related health concern, coeliac disease, ▇▇▇▇▇▇▇▇▇’▇ disease, Alzheimer’s or Dementia, cognitive impairment, neural impairment, mental illness, pregnancy-related disease, health or medical conditions, conception, or any condition or event relating to childbirth or any condition or disease such as immune-related diseases, compromise, or response together with chronic conditions, weight gain, loss or weight management, organ dysfunction, eyesight or hearing, skin, reproductive, neurological, respiratory, vascular, circulatory disease or genetic illness or condition, end of life, or any predisposition to any form of illness, health concern or condition;
(e) we cannot slow down the natural ageing process, or the progression of any illness or condition, reduce pain or suffering, treat, cure, predict or promise to improve any existing or future illness, health or wellbeing concern, or condition.

(d) slow down the ageing process, or the progression of any illness or condition, increase fertility, reducing pain or suffering, treat, cure, predict or promise to improve any existing or future illness, health or wellbeing concern, or condition.
