Common use of Other Guarantees Clause in Contracts

Other Guarantees. It is hereby expressly placed on record that the surety bond evidenced herein is without prejudice to any other security interests and prohibitions that could have been granted by the Surety, the Debtor and/or any third parties, either in personam or in rem, to secure fulfillment of the secured obligations to the Creditor. The agreements evidenced in this public deed shall not be construed under any circumstance as an amendment, substitution, or restriction on the rights granted to the Creditor, the Collateral Agent under the Credit Facility Agreement or any amendments thereto.
