Other Publications. The MCO, acting indirectly through the publications and other material made available by the Local Agency or the STATE, or through mass media advertising (including the internet), may inform Beneficiaries who reside in the Service Area of this Contract of the availability of medical coverage through the MCO, the location and hours of service and other plan characteristics, subject to subject to all restrictions in this section.
Other Publications. The MCO, acting indirectly through the publications and other material distributed by the Local Agency or the STATE, or through mass media advertising (including the Internet), may inform Recipients who reside in the Service Area as defined in section 3.1.1(A) of this Contract of the availability of medical coverage through the MCO, the location and hours of service and other plan characteristics, subject to section 3.2.6(B)(5).
(1) The MCO may also distribute brochures and display posters at physician offices and clinics, informing patients that the clinic or physician is part of the MCO’s Provider network.
(2) The MCO may provide health education materials for Enrollees in Providers’ offices.
(3) All posters, brochures and Provider network-related materials must be Prior Approved by the STATE and/or CMS as required in accordance with this Article.

Other Publications. The Parties will mutually agree upon the contents of a joint press release which shall be issued simultaneously by both Parties upon the Effective Date. During the Term, Aventis and Regeneron agree not to (and to ensure that their respective Affiliates do not do so) issue any other press releases or public announcements concerning this Agreement or any Ancillary Agreement or any other activities contemplated thereunder without the prior written consent of the other Party to the form, timing and content of any such release or announcement, except as required by a Governmental Authority or applicable Law, and, subject to the further provisions of this Section 16.4, each Party agrees to provide to the other Party a copy of any public announcement, as soon as reasonably practicable (which, except under extraordinary circumstances, shall be at least five (5) Business Days) prior to its scheduled release; provided, however, that, without prior submission to or approval of the other Party, either Party may issue press releases or public announcements which incorporate information concerning this Agreement or any Ancillary Agreement or any activities contemplated thereunder which information was included in a press release or public announcement which was previously approved by the other Party as part of a press release or other public disclosure concerning this Agreement or which contains only non-material factual (non-financial) information regarding the Collaboration (e.g., that the Collaboration is ongoing in accordance with the terms of this Agreement). Except as otherwise required by applicable Law, the Party whose press release has been reviewed shall remove any information the reviewing Party reasonably deems to be inappropriate for disclosure. Neither Party shall unreasonably withhold or delay its consent to any such press release or announcement. Except as required by Law, or in connection with the enforcement of this Agreement, neither Party (or their respective Affiliates) shall disclose to any Third Party, under any circumstances, any financial terms of this Agreement that have not been previously disclosed publicly pursuant to this Article 16 without the prior written consent of the other Party, which consent shall not be unreasonably withheld or delayed; except for disclosures to Third Parties that are bound by obligations of confidentiality and nonuse at least equivalent in scope to those included herein. Other Publications. Except as provided in this Section 11.4(c) or as otherwise agreed by the Parties or required by any publications strategy established by the JDC under Section 3.2(b)(vi), MERRIMACK will have no obligation to provide to PEI any press releases, publications, presentations or other public disclosures arising from the activities contemplated under this Agreement prior to their publication or disclosure. MERRIMACK will ensure that all public disclosures it makes relating to the activities contemplated under this Agreement or MERRIMACK’s exercise or the rights granted it under this Agreement will be consistent with any publications strategy established by the JDC under Section 3.2(b)(vi), and MERRIMACK will provide to PEI a copy of each press release, scientific publication, scientific presentation and other written or electronic scientific public disclosure promptly after such disclosure is made. Any such scientific publication or presentation shall appropriately acknowledge the efforts and support of PEI, as applicable.
Other Publications. For all other Publications, including but not limited to poster presentations, abstract submissions, investor presentations and the like, both Parties will submit such proposed Publications at least ten (10) Business Days prior to submitting it to any Third Party (including any editing Person) for publication or disclosure. For the avoidance of doubt, Publications exclude marketing materials.
11.4.2.1 The other Party will have five (5) Business Days after receipt of the draft Publication to review and comment on such draft.
11.4.2.2 Upon Notice within such five (5) Business Day period by the other Party that it reasonably believes the Publication would amount to the public disclosure of such other Party’s Confidential Information and/or negatively impact such other Party’s intellectual property position, submission of the concerned Publication to Third Parties will be delayed for a sixty (60) day period from the date of said Notice for appropriately deleting Confidential Information from the proposed Publication or drafting and filing a patent application with respect to any subject matter to be made public in such Publication. Notwithstanding the foregoing, neither Party shall be restricted hereunder from making any publication or disclosure to extent required to comply with Applicable Law.
Other Publications. (1) Each publication or communication, whether written or oral, is required to have obtained the consent of the Parties concerned in the publication by way of contribution of data or know-how. To this end, a brief description and the subject of the proposed publication or communication shall be submitted to the TA, a copy of which shall be provided to all Parties.
(2) If none of the Parties concerned in the publication by way of contribution of data or know-how objects to the publication within one (1) calendar month from the date of referral, consent shall be deemed to be given.
(3) Any objection shall include, • a request for modifications, specifically if information contained in the proposed publication or communication is likely to impair the industrial and commercial Use of Knowledge; or • a request that the publication or communication shall be postponed if, in its opinion, serious reasons require this, especially if the information contained in the proposed publication or communication could affect the protection of knowledge of the objecting Party.
(4) If a dispute regarding a publication cannot be settled amicably within two (2) calendar months, the Steering Committee shall decide the issue within a period of six (6) months starting from the date of the first submission of the publication to the TA.
(5) It is understood that any non-journalistic publication or communication made pursuant to this Section is required to indicate the contribution made by each of the Parties. Any non-journalistic publication in connection with the Project shall make reference to the EVAN consortium and indicate the Commission's financial support as established in the Contract, Annex II. (6) The Parties understand that GEO is dedicated to publishing a popular-science magazine addressed to the broad public and they agree that GEO shall be entitled to publish results of the Project in such a way under the following cumulative conditions: - GEO's publication shall not anticipate first publications of the respective results in a scientific journal by a Party, - GEO's publication shall not anticipate applications for intellectual property rights, especially applications for a patent, and - GEO shall inform the Co-ordinator as early as possible of the content of its planned publicat...
