Other Systems and Applications. Each year in the first calendar quarter, First Data shall identify all systems and applications relating to the Services not considered “critical” as provided in Section 5.1. First Data shall present annually its Plans (including back up and recovery strategy) for such non-critical systems and applications in the event of a Disaster. RCSI shall have the opportunity to propose modifications to the list and Plans for such systems and applications. If the Parties are unable to agree on such modifications, RCSI may escalate the issue to the Chief Information Officer of GECF-A (or his or her designee) and the Chairman of FDC (or his designee) for attempted resolution, and failing resolution within thirty (30) days following escalation, the dispute shall be subject to Section 20.2 of the Main Body of the Agreement.
