Common use of Other Termination by Company Clause in Contracts

Other Termination by Company. If the Executive’s employment with the Company is terminated by the Company other than by reason of death, Disability or Cause, subject to the procedures set forth in Section 14 herein, the Executive (or in the event of the Executive’s death following the Termination Date, the Executive’s surviving spouse or the Executive’s estate if the Executive dies without a surviving spouse) shall receive the Executive’s Accrued Benefits and the applicable Termination Payment. The Executive shall not, in connection with any consideration receivable in accordance with this Section 11, be required to mitigate the amount of such consideration by securing other employment or otherwise and such consideration shall not be reduced by reason of the Executive securing other employment or for any other reason.

Other Termination by Company. If the Executive’s 's employment with the Company is terminated by the Company other than by reason of death, Disability or Cause, or as described in paragraph 13(g) below, subject to the procedures set forth in Section 14 herein, the Executive (or in the event of the Executive’s 's death following the Termination Date, the Executive’s 's surviving spouse or the Executive’s 's estate if the Executive dies without a surviving spouse) shall receive the Executive’s Accrued Benefits and the applicable Termination Payment. The Executive shall not, in connection with any consideration receivable in accordance with this Section 11, be required to mitigate the amount of such consideration by securing other employment or otherwise and such consideration shall not be reduced by reason of the Executive securing other employment or for any other reason.

The Executive shall not, in connection with any consideration receivable in accordance with this Section 11, be required to mitigate the amount of such consideration by securing other employment or otherwise and such consideration shall not be reduced by reason of the Executive securing other employment or for any other reason.

If the Executive’s Executives employment with the Company is terminated by the Company other than by reason of death, Disability or Cause, or as described in paragraph 13(f) below, subject to the procedures set forth in Section 14 herein, the Executive (or in the event of the Executive’s 's death following the Termination Date, the Executive’s 's surviving spouse or the Executive’s 's estate if the Executive dies without a surviving spouse) shall receive the Executive’s Accrued Benefits and the applicable Termination Payment. The Executive shall not, in connection with any consideration receivable in accordance with this Section 11, be required to mitigate the amount of such consideration by securing other employment or otherwise and such consideration shall not be reduced by reason of the Executive securing other employment or for any other reason.

If the Executive’s 's employment with the Company is terminated by the Company other than by reason of or death, Disability disability or Cause, subject to the procedures set forth in Section 14 herein, the Executive (or in the event of the Executive’s 's death following the Termination Date, the Executive’s 's surviving spouse or the Executive’s 's estate if the Executive dies without a surviving spouse) shall receive the Executive’s Accrued Benefits and the applicable Termination PaymentPayment as defined in Section 13(b) and other benefits described in Sections 6(b) through 6(e) herein. The Executive shall not, in connection with any consideration receivable in accordance with this Section 11, be required to mitigate the amount of such consideration by securing other employment or otherwise and such consideration shall not be reduced by reason of the Executive securing other employment or for any other reason.
