Over Budget Options. 6.8.1 If the Construction Budget is exceeded by the total of the lowest responsive and responsible Bids and any legally negotiated prices for the Project, the Contracting Authority and Owner shall, at their option: 6.8.1.1 Approve in writing an increase in the Construction Budget and rebid the Project; 6.8.1.2 Authorize rebidding or renegotiation for some or all parts of the Project within a reasonable time without an increase in the Construction Budget; 6.8.1.3 Abandon the Project, in whole or in part, and terminate this Agreement; or 6.8.1.4 Cooperate in the revision of the Project Scope as defined in Section 5.3.2.3.1 to reduce the actual cost of construction to the Construction Budget. 6.8.2 If the Contracting Authority and Owner adopt the option in Section 6.8.1.1 above and such increase in the Construction Budget is more than 10 percent, the A/E may request, in writing, an adjustment to the Basic Fee. 6.8.3 If the Contracting Authority and the Owner adopt the option in Section 6.8.1.4 above, the A/E shall appropriately modify the Approved Program of Requirements, Project Schedule, and Contract Documents and cooperate in any necessary bidding or negotiation without additional charge.
