Own Funds Sample Clauses
Own Funds. No Agent shall be under any obligation to risk or expend its own funds to take any action under this Agreement which it expects will result in any expense or liability accruing to it, the payment of which is not, in its opinion assured to it.
Own Funds. The Collateral Agent shall not be under any obligation to take any action other than as expressly set forth in this Common Agreement or the other Loan Documents to which it is a party that involves any expense or liability, the payment of which, within a reasonable time, is not, in the reasonable opinion of the Collateral Agent, assured to it. Nothing in this Common Agreement shall be interpreted to require the Collateral Agent to advance or expend its own funds to make any payments hereunder. The Collateral Agent shall not be required to invest, or be under any liability for interest, on any monies at any time received by it pursuant to any of the provisions of this Common Agreement, except as otherwise expressly provided herein or in any other Loan Document to which it is a party.
Own Funds. The Class A-3 Note Agent shall not be required to, and shall not, expend or risk any of its own funds or otherwise incur any financial liability in the performance of any of its duties hereunder if it shall have reasonable grounds to believe that repayment of such funds or adequate indemnity against such liability in accordance with the terms hereof is not reasonably assured to it.
Own Funds. No provision of the Agreement shall require Collateral Agent to expend or risk its own funds or to otherwise incur any financial liability in the performance of any of its duties hereunder or under any of the other Note Documents to which it is a party, or in the exercise of any of its rights or powers, if it shall have reasonable grounds for believing that repayment of such funds or adequate indemnity against such risk or liability is not reasonably assured to it.
Own Funds. Nothing contained in this Agreement or the other Transaction Documents shall require the Security Trustee to expend or risk its own funds or otherwise incur any financial liability and the Security Trustee shall not be obliged to do or omit anything, including entering into any transaction or incurring any liability if it shall have reasonable grounds for believing that repayment of such funds or adequate indemnity and/or security and/or pre-funding against such risk or liability is not assured to it.
Own Funds. No Paying Agent shall be under any duty to risk and/or expend its own funds or otherwise incur any financial liability if it determines that the repayment of such funds is not assured to it within a reasonable time.
Own Funds. Except as may be otherwise provided in this Agreement, the Facility Agent is not expected to expend or risk its own funds or otherwise incur financial liability in the performance of any of its duties or in the exercise of any of its rights or powers if there is reasonable ground for believing the repayment of such funds or liability is nor reasonably assured to it under the terms of this Agreement, including the furnishing of any bond or undertaking.
Own Funds. Nothing contained in this Trust Deed, the Notes, the Agency Agreement or any related document shall require the Trustee to expend or risk its own funds or otherwise incur any financial liability in the performance of its duties or the exercise of any right, power, authority or discretion hereunder if it has grounds for believing the repayment of such funds or adequate indemnity, or security for, against such risk or liability is not reasonably assured to it.
Own Funds. No provision of this Agreement shall require the Rights Agent to expend its own funds in the performance of any of its duties hereunder or in the exercise of its rights if it believes that repayment of such funds is not reasonably assured to it.
