Common use of Owner as Third Party Beneficiary Clause in Contracts

Owner as Third Party Beneficiary. No Subcontractor is intended to be nor shall it be deemed a third party beneficiary of this Agreement. Nothing contained herein shall obligate Owner to pay any Subcontractor and Contractor shall be solely responsible for paying each Subcontractor in accordance with the applicable Subcontract or purchase order between Contractor and the Subcontractor; provided, however, each agreement between Contractor and a Subcontractor with respect to the Work shall name Owner as an intended third party beneficiary.
