Common use of Owner to be paid for property damage Clause in Contracts

Owner to be paid for property damage. If the Distributor is liable to pay the Retailer any amount in accordance with this clause in respect of property damage that is not related to the property of the Retailer, the Retailer must pass through the amount received by it from the Distributor in relation to that property damage to the owner of the affected property (whether or not that person is a Consumer). The Distributor may, with the prior written consent of the Retailer (such consent not to be unreasonably withheld), pay such amount directly to the property owner instead of to the Retailer. In such circumstances, the Retailer must provide the Distributor with the information required to enable the Distributor to make payment, and the Distributor must inform the Retailer as soon as reasonably practicable after making such payment.
