Common use of Owner's Construction Inspection Rights Clause in Contracts

Owner's Construction Inspection Rights. During the Agreement Term and any period of Manager's fixturing or construction in the Premises, Owner shall have the right to physically inspect, and to cause one or more engineers or other representatives of Owner to physically inspect, the Premises, as long as the same does not substantially interfere with Manager's operation of or construction activities on the Premises. Such inspections shall include (without limitation) such tests, inspections and audits of environmental and soil conditions as Owner deems necessary. Owner shall make such inspections in good faith and with due diligence. All inspection fees, appraisal fees, engineering fees, environmental fees and other expenses of any kind incurred by Owner relating to the inspection of the Premises will be solely at Owner's expense. Manager shall cooperate (at no cost or liability to Owner) with Owner in all reasonable respects in making such inspections. Manager reserves the right to have a representative present at the time Owner conducts any such inspection of the Premises. In making any inspection, Owner will treat, and will cause any representative of Owner to treat, all information obtained by Owner pursuant to the terms of this Section 22.2 as strictly confidential.
