Common use of Owner’s Payment to Contractor Mandatory Clause in Contracts

Owner’s Payment to Contractor Mandatory. A. Owner’s payment to Contractor shall be a condition precedent to Contractor’s obligation to pay Subcontractor and Subcontractor’s right to receive payment. Subcontractor hereby acknowledges that it is assuming the risk of non-payment by the Owner. This condition precedent also applies to Contractor’s obligation to pay Progress Payment, Change Orders, Retainage, Final Payment and any other payment required by the Contract Documents. This paragraph supersedes all other provisions of this Subcontract Agreement, and any conflicting language shall be modified or deemed to be consistent herewith.
