Overpayments to Contractor. Contractor shall refund to Participating/Purchasing Entity the full amount of any erroneous payment or overpayment under this Master Agreement within thirty (30) days’ written notice. If Contractor fails to make timely refund, Purchaser may charge Contractor one percent (1.5%) per month on the amount due, until paid in full.

Overpayments to Contractor. In the event that overpayments or erroneous payments have been made to the Contractor under this Contract, HCA will provide written notice to Contractor and Contractor will refund the full amount to HCA within thirty (30) calendar days of the notice. If Contractor fails to make timely refund, HCA may charge Contractor one percent (1%) per month on the amount due, until paid in full. If the Contractor disagrees with HCA’s actions under this section, then it may invoke the dispute resolution provisions of Section 4.13
Overpayments to Contractor. Contractor shall promptly, but in all cases within 30 calendar days, pay to the Department the full amount of any erroneous payment or overpayment immediately following Notice of an erroneous payment or overpayment to which Contractor is not entitled or shall take another approach that the Department accepts for how to address the overpayment or erroneous payment and that is described in a Notice from Contractor received within 30 calendar days of such notice from the Department.
Overpayments to Contractor. Contractor shall return to the Commission any overpayments due to unearned funds or funds disallowed pursuant to the terms of this Contract that were disbursed to Contractor by the Commission. In the event that Contractor or its independent auditor discovers that overpayment has been made, Contractor shall repay said overpayment within forty (40) calendar days without prior notification from the Commission. In the event that the Commission first discovers an overpayment has been made, the Commission will notify Contractor in writing. Should repayment not be made in a timely manner, the Commission shall be entitled to charge interest at the lawful rate of interest established pursuant to Section 55.03(1), F.S., on the outstanding balance beginning forty (40) calendar days after the date of notification or discovery. Refunds should be sent to The Commission’s Contract Manager, and made payable to the “The Florida Fish and Wildlife Conservation Commission.”

If Contractor fails to make timely refund, OSOS may charge Contractor one percent (1%) per month on the amount due until paid in full. RECORDS MAINTENANCE Contractor shall maintain books, records, documents, data and other evidence relating to this Contract and performance of the services described herein, including but not limited to accounting procedures and practices that sufficiently and properly reflect all direct and indirect costs of any nature expended in the performance of this Contract. Contractor shall retain such records for a period of six years following the date of final payment. At no additional cost, these records, including materials generated under the Contract, shall be subject at all reasonable times to inspection, review or audit by OSOS, personnel duly authorized by OSOS, the Office of the State Auditor, and federal and state officials so authorized by law, regulation or agreement. If any litigation, claim or audit is started before the expiration of the six-year period, the records shall be retained until all litigation, claims or audit findings involving the records have been resolved.

If Contractor fails to make such a timely credit, WSP may charge Contractor one percent per month on the amount due until paid in full. Advance Payments Prohibited. No advance payment shall be made for goods or Services furnished by Contractor pursuant to this Contract. Credits. Any credits due WSP under this Contract may be applied against Contractor’s invoices with appropriate information attached, upon giving of Notice required herein, if any, by WSP to Contractor.
