Common use of Ownership of Transmission Owner Interconnection Facilities and Merchant Network Upgrades Clause in Contracts

Ownership of Transmission Owner Interconnection Facilities and Merchant Network Upgrades. The Interconnected Transmission Owner shall own all Transmission Owner Interconnection Facilities and Merchant Network Upgrades that it builds. In addition, the Interconnection Customer will convey to the Interconnected Transmission Owner, as provided in Section 5.5 of this Appendix 2, title to all Transmission Owner Interconnection Facilities and Merchant Network Upgrades built by the Interconnection Customer pursuant to the terms of Section 3.2 of this Appendix 2. Nothing in this section shall affect the interconnection rights otherwise available to a Transmission Interconnection Customer under Subpart C of Part VI of the Tariff.
