Common use of PacifiCorp’s Acceptance of Offer Clause in Contracts

PacifiCorp’s Acceptance of Offer. If PacifiCorp accepts an offer made by Seller (or its Affiliate) under this section, the parties shall within sixty (60) days following such acceptance enter into a power purchase agreement in substantially the same form as this Agreement for the purchase and sale of such Expansion Energy (with appropriate provisions proportionally adjusted to account for the size of the proposed expansion relative to the Nameplate Capacity Rating of the Facility), but incorporating such changes as are expressly identified in the terms and conditions offered by Seller (or its Affiliate).
