Packaging Materials and Containers for Retail Sale. 1. Packaging materials and containers for retail sale, which are classified with the good, pursuant to Rule 5 of the General Rules for the Interpretation of the Harmonized System, shall be disregarded in determining the origin of the good, provided that: (a) the good is wholly obtained or entirely produced as defined in subparagraph (a) of Article 39; (b) the good is produced exclusively from originating materials, as defined in subparagraph (b) of Article 39; or (c) the good has undergone the applicable change in tariff classification or a specific manufacturing or processing operation set out in Annex 3. 2. If a good is subject to a qualifying value content requirement, packaging materials and containers used for retail sale shall be considered as originating or non- originating materials of the good, as the case may be.
