Pandemic Contractual Performance. ‌ a. The Department shall require a written plan that illustrates how the Consultant shall perform up to contractual standards in the event of a pandemic. The Department may require a copy of the plan at any time prior to or at post-award phase of the Contract. At a minimum, the pandemic performance plan shall include: 1. The Department shall not incur any liability if a pandemic is declared and emergency procurements are authorized by ADOT Director pursuant to §41-2537 of the Arizona Procurement Code (APC). 3. Once the pandemic is officially declared over or the Consultant can demonstrate the ability to perform, the Department, at its sole discretion may reinstate the temporarily voided Contract(s). c. In the event of a pandemic, as declared by the Governor of Arizona, U.S. Government or the World Health Organization (WHO)Organization, which makes performance of any term under this Contract impossible or impracticable, the Department State shall have the following rights:: ( 1. i) After the official declaration of a pandemic, the Department State may temporarily place void the Contract(s) on “HOLD,” in whole or in part, specific sections if the Consultant Contractor cannot perform to the standards agreed upon in the initial terms. 2. ; (ii) The Department State shall not incur any liability if a pandemic is declared and emergency procurements are authorized by ADOT Director pursuant to §the director as per § 41-2537 of the Arizona Procurement Code Code; and (APC). 3. iii) Once the pandemic is officially declared over or and/or the Consultant Contractor can demonstrate the ability to perform, the DepartmentState, at its sole discretion may reinstate the temporarily voided Contract(scontract(s). c. 18.2 The DepartmentState, at any time, may request to see a copy of the written plan from the ConsultantContractor. The Consultant Contactor shall produce the written plan within 72 hours of the request.
