Common use of Pari Passu Obligations Clause in Contracts

Pari Passu Obligations. The Company covenants that its obligations under the Notes and under this Agreement and the Other Agreements do and will rank at least pari passu in right of payment with all of its present and future unsecured and unsubordinated indebtedness, except for those obligations that are mandatorily preferred by law.

Pari Passu Obligations. The obligations of the Company covenants that its obligations under the Notes and under this Agreement and the Other Agreements do and will Transaction Documents constitute direct obligations that (save as expressly subordinated thereby) rank at least pari passu in right of payment with all of its present and future other unsecured and unsubordinated indebtedness, except for obligations (other than those obligations that are mandatorily preferred by law).

Pari Passu Obligations. The Company covenants hereby acknowledges and agrees that its the obligations of the Company with respect to the Deferred Notes (including, without limitation, under the Notes and under this Agreement and the Other Agreements do and will rank at least any guarantee thereof) shall be pari passu in right of payment payment, liens (if any) or other security (if any) with all of its present and future unsecured and unsubordinated indebtedness, except for those obligations that are mandatorily preferred by lawthe Obligations.

The Company covenants that its obligations under the Notes and under this Agreement and the Other Agreements other Financing Documents do and will rank at least pari passu in right of payment with all of its other present and future unsecured secured and unsubordinated indebtedness, except for those Debt. Each Guarantor covenants that its obligations that are mandatorily preferred by lawunder the Guarantee do and will rank at least pari passu in right of payment with all its other present and future secured and unsubordinated Debt.

The obligations of the Company covenants that its obligations under the Notes and under this Agreement and the Other Agreements do hereunder rank and will at all times rank at least pari passu in right of payment with all other obligations of the Company in respect of its present and future unsecured and unsubordinated indebtedness, except indebtedness for those obligations that are mandatorily preferred by lawborrowed money.
