Common use of Pari Passu Status Clause in Contracts

Pari Passu Status. Ensure, and cause each of its Designated Subsidiaries to ensure, that the Debt outstanding under this Agreement and the Notes ranks at least pari passu with all other senior unsecured Debt of the Company or such Designated Subsidiary, as the case may be.

Pari Passu Status. Ensure, and cause each of its Designated Subsidiaries to ensure, that the Debt outstanding under this Agreement and the Notes (including without limitation, in the case of the Guarantor, the payment obligations of the Guarantor under its Guaranty) ranks at least pari passu with all other senior unsecured Debt of the Company such Loan Party or such Designated Subsidiary, as the case may be.
