Common use of Partial Utilization Clause in Contracts

Partial Utilization. The City may request, in writing, the use of any part of the Work which may be used without significant interference with construction of other parts of the Work. If the City requests use of any part of the Work prior to Substantial Completion of all the Work, the City will issue to the Design-Builder a letter granting Substantial Completion for that portion of the Work with a list of items to be completed or corrected. The City will assume responsibility for security, safety, operation, maintenance, and utilities for that part of the Work while it is being used by or under the control of the City.
