Common use of Participant’s Obligations Clause in Contracts

Participant’s Obligations. In addition to the other obligations contained in this Agreement, the Participant will fulfill the following obligations: (a) develop actionable recommendations to achieve the Savings Target based on the data obtained from the M&T System within 12 months of the installation of the M&T System; (b) implement any Project identified by the Participant with a Project Payback of less than 12 months within 12 months of identifying such Project in the M&T Annual Report; (c) achieve the Savings Target within 24 months of the installation of the M&T System and sustain such Savings Target during the term of this Agreement; (d) notify the LDC upon the completion of the installation and commissioning of the M&T System and provide the LDC with written confirmation of the installation from a registered professional engineer licensed to practice in Ontario, who may be an employee of the Participant; and (e) commission the M&T System within six months of the date of this Agreement.
