Parts Availability. If a Device part is not available at the time you make a Mobile Refresh Request, this may impact the timings stated in clause 7.2.2. We will inform you of the delay and the updated timings to complete your Mobile Refresh Request.

This Parts availability requirement shall survive the term and any termination of this Agreement.

Parts Availability. Since the continuous operation of the City of Mesa’s equipment is important and sometimes of an emergency nature, the successful bidder must be in a position to render prompt parts support. The availability of normal wear items (filters, belts, hoses, and cutting edges) shall not exceed one (1) working day. The parts inventory shall be of sufficient size and variety to offer a level of availability of 95% of all parts within two (2) working days after the date of City of Mesa order. The successful bidder shall maintain and/or have access to a parts inventory that can meet the City of Mesa’s delivery requirements. Submission of this bid shall constitute a guarantee by the bidder that a complete stock of replacement parts for the specified equipment is available and the bidder is in agreement with this provision.
Parts Availability. If parts required for Equipment Maintenance Services are no longer available, Entrust may terminate coverage for some or all of the affected Covered Equipment and will issue Customer a prorated credit for the remaining term of the applicable Order.

No payment made under this agreement shall be conclusive evidence of the performance of the price agreement either wholly or in part, and that no payment made for the delivery of the items in whole or in part shall be construed as an acceptance of defective work or improper materials, nor relieve the Vendor from corrections of the defects. The final acceptance shall not be binding upon the Purchaser or the State, or conclusive, should it subsequently develop the Vendor has furnished inferior items or had departed from the specifications and/or the terms of the agreement. Should such conditions become evident, the ordering agency shall have the right, notwithstanding final acceptance and payment, to cause the item(s) to be properly furnished in accordance with the specifications (and drawings, if any) at the cost and expense of the Vendor.
