Common use of Patterns of Noncompliance Clause in Contracts

Patterns of Noncompliance. Repeated failure to meet Contractor’s Performance Standards may serve as evidence that Contractor does not provide Qualified Dental Plans in the best interest of Covered California Enrollees for the purposes of Government Code § 100503, subdivision (c). Covered California may consider Contractor’s patterns of noncompliance with Contractor’s Performance Standards, including repeated necessity for CAPs, as part of its annual Recertification and Decertification process, assessing the severity of noncompliance and Contractor’s good faith efforts to identify and address systemic issues.
