PAYING POLICE DETAILS. The following procedures shall be adhered to in the assignment and recording of all paying police details: A. All employees will signify in writing from time to time their desire to accept or not to accept paying police details, which details shall be voluntary, and a current file on this subject will be maintained at police headquarters and made available upon the request to the Union. B. All details will be assigned by the Chief or his designee. C. Except by agreement of the Town and the Union, no paying detail assignments shall be made until the firm, corporation or entity requesting or required to have such detail has agreed to pay the Town for each officer performing such detail at the rate specified in section F. Such payments shall be made directly to the Town of Upton. D. The Chief of Police will determine when a paid detail is necessary and shall assign such details as equitably as practicable. The Chief shall offer paying police details to full-time officers first and in the event that no full-time officer accepts the detail, he may offer it to part-time officers. The Town agrees that when the Police Chief deems that traffic protection is necessary on ways owned or maintained by the Town as a condition for a permit as outline in Chapter 4 Section 1 and 2 of the Town Bylaws or otherwise, such traffic protection shall be provided only by Upton Police Officers. E. A paying police detail is defined as a tour of duty outside the regular hours of work resulting from the request of a third party outside the Department, for which said third party pays. F. Police officers shall be compensated for paying police details at the following rate: OUTSIDE DETAILS INSIDE DETAILS 7-1-21 $53.00 per hour $50.50 per hour 7-1-22 $54.00 per hour $51.00 per hour 7-1-23 $55.00 per hour $51.50 per hour G. Paying Police Detail rates shall become effective with the signing of this agreement. H. Paying Police details scheduled on nights, weekends, holidays shall be paid at time and one half the detail rate. Officers working in excess of eight (8) hours shall be paid at time and one half the detail rate for that portion of the detail exceeding eight (8) hours. This section does not apply to: schools, churches, or nonprofit. For the purpose of this section a weekend shall be defined as 6:00 P.M. on Friday to 7:00 A.M. on Monday. Nights shall be defined as the hours between 6:00 P.M. and 7:00 A.M. Only hours worked between these times shall be compensated at the time and one half rates. I. Officers working paying police details shall be paid a minimum of four (4) hours. In the event that the detail continues for more than four but less than eight hours the officer will be paid a minimum of eight hours. The eight hour minimum shall not apply to, schools, and churches, nonprofit organizations or elections. J. The Town agrees to allow Upton Police Officers to obtain off duty employment without undue restrictions. Officers working such off duty employment agree to terminate off duty work shift activities upon receipt of an emergency call from the department. The Union agrees to comply fully with the provisions of Department Rule 4.1 regarding such employment, and the Town agrees to lodge only realistic objections to a members’ off duty work intentions

All Paying Police Details will be distributed to employees fairly and equitably as to the number of details, hours and compensation therefor. 32.5. Employees shall be given the maximum possible advance notice of paying detail assignments. Any employee who refused a paying detail shall not be removed from the detail list, but any such refusal shall be recorded for the purpose of detail assignment as a detail actually worked under the heading "Detail Refusal" (DR) with the detail hours thereof noted, in determining the equitable and fair distribution of details to such employees. 32.6. The officer of rank shall be responsible for recording all assigned paying police details and shall have such assignments posted on detail distribution forms daily for the attention of all employees. These forms shall be placed on a bulletin board at the Station, and shall include the employee’s name, detail worked, name of person, firm, corporation or entity serviced, number of hours worked, type of detail, compensation received per detail, detail refusal and applicable dates. 32.7. Any person who performs a paying detail not officially assigned by such superior officer and recorded and reported as required by the Agreement will not be protected by the provisions of MGL Chapter 41, Sections 100 and 111 F as amended. 32.8. Any employee’s claim that he/she has not received his fair share of paying details pursuant to the provisions of the article shall constitute a grievance under this Agreement. 32.9. Detail distribution forms shall be official records of the Department and shall be made available to the Union for its inspection and use upon its request. 32.10. Regular Full-Time employees (Patrol Officers and Sergeants) of the Police Department shall have the right of first refusal for all Paying Police Details. 32.11. No extra paid detail assignment shall be made until and unless the requesting organization or required to have such detail activity has agreed to the following rates of pay per employee: 32.11.1. For the Town for each officer performing such detail at period of July 1, 2021 through June 30, 2024, the rate specified in section F. Such payments shall be made directly to of compensation received for details worked for the Town of Upton. D. The Chief Xxxxxxx shall be forty five dollars ($45.00) per hour for the first eight (8) hours of Police will determine when a paid detail is necessary and shall assign such details as equitably as practicable. The Chief shall offer paying police details to full-time officers first and in the event that no full-time officer accepts the detail, he may offer it to partwith a four (4) hour minimum, including weekends and holidays; and sixty-time officers. The Town agrees that when the Police Chief deems that traffic protection is necessary on ways owned or maintained by the Town as a condition for a permit as outline in Chapter 4 Section 1 seven dollars and 2 of the Town Bylaws or otherwise, such traffic protection shall be provided only by Upton Police Officers. E. A paying police detail is defined as a tour of duty outside the regular hours of work resulting from the request of a third party outside the Department, for which said third party pays. F. Police officers shall be compensated for paying police details at the following rate: OUTSIDE DETAILS INSIDE DETAILS 7-1-21 fifty cents ($53.00 67.50) per hour $50.50 per for each hour 7-1-22 $54.00 per hour $51.00 per hour 7-1-23 $55.00 per hour $51.50 per hour G. Paying Police Detail rates shall become effective with the signing of this agreement. H. Paying Police details scheduled on nights, weekends, holidays shall be paid at time and one half the detail rate. Officers working worked in excess of eight (8); 32.11.2. For the period of July 1, 2021 through June 30, 2024, the rate of compensation received for details worked for clients other than the Town of Xxxxxxx shall be fifty five dollars ($55.00) per hour for the first eight (8) hours of the detail, with a four (4) hour minimum, and eighty two dollars and fifty cents ($82.50) per hour for each hour worked in excess of eight (8). Hours between midnight Friday and midnight Sunday, and Holidays, shall be paid at time a rate of eighty two dollars and fifty cents ($82.50) per hour, and one half the detail rate hundred twenty-three dollars and seventy-five cents ($123.75) per hour for that portion each hour worked in excess of the detail exceeding eight (8) hours8); 32.11.3. This section does not apply to: schools, churches, or nonprofit. For the purpose of this section a weekend There shall be defined as 6:00 P.M. on Friday to 7:00 A.M. on Monday. Only hours an additional five ($5.00) dollars per hour for each detail worked between these times shall be compensated at the time and one half ratesa location where alcoholic beverages are served. I. 32.12. Officers working paying police details shall be paid a minimum of four (4) hours. In the event for outside agencies that the detail continues for last more than four 4 hours, but less than eight hours the officer 8 hours, will be paid a minimum of eight 8 hours. The eight Details for town departments and functions will be paid the 4 hour minimum shall not apply to, schools, and churches, nonprofit organizations or electionshour for hour after the first 4 hours. J. The 32.13. An employee engaged in performing an extra paid detail, so-called, for persons, firms, corporations, entities, or other Police Agency not under the jurisdiction of the Town agrees of Xxxxxxx shall be paid at his/her own rate under this Agreement or other Agency's rate, whichever is the highest rate of pay. 32.14. If an officer accepts a paid detail and is unable to allow Upton Police Officers begin his/her assigned shift on time due to obtain off duty employment without undue restrictionsthe detail being longer than anticipated, it will be the responsibility of the officer to make arrangements for shift coverage. 32.14.1. Officers working such off duty employment If personnel agree to terminate off duty work shift activities upon receipt of an emergency call from cover for the department. The Union agrees to comply fully with detail officer, then said personnel will be paid for the provisions of Department Rule 4.1 regarding such employment, time covered and the Town agrees officer working the detail will only be paid for the exact/actual hours of work on that day. 32.14.2. If an officer accepts a paid detail and is unable to lodge only realistic objections secure proper coverage, the officer will be required to a members’ off arrive for duty work intentionsat the assigned time regardless of the status of the detail.
